The Ontario Physicians and Surgeons Discipline Tribunal

The Ontario Physicians and Surgeons Discipline Tribunal (OPSDT) is a neutral, independent, administrative tribunal that adjudicates allegations of professional misconduct or incompetence of Ontario physicians made by the College of Physicians and Surgeons of Ontario. The Tribunal is made up of physicians, non-physician members of the public and experienced adjudicators and holds hearings in a trial-like process. Dr. Tahmoures Bahrami #105123 

On January 16, 2024, the Tribunal found that Dr. Bahrami engaged in disgraceful, dishonourable or unprofessional conduct and failed to meet the standard of practice of the profession in his treatment of Patient A. The acts of professional misconduct found by the panel included that Dr. Bahrami: 

  • failed to explain the type of examination he was performing on Patient A when she saw him for a physical, touching her in a manner that made her feel uncomfortable; 
  • made inappropriate comments towards Patient A during an appointment 
  • failed to do the following during an appointment where he examined Patient A’s breasts: 
    • offer Patient A a chaperone;
    • offer Patient A a gown or drape;
    • obtain Patient’s A’s agreement prior to adjusting, moving, or removing her clothing, including her bra; and
    • provide Patient A with privacy while undressing and dressing.

Dr. Ashley John Mercado #82497 

On February 8, 2024, the Tribunal found that Dr. Mercado engaged in disgraceful, dishonourable or unprofessional conduct by inappropriately, and without consent or authorization, accessing the health records of approximately 20 individuals who were not under his care, including but not limited to family members, colleagues and others. Dr. Cholemkeril Kuncheria Thomas #54092 

On February 27, 2024, the Tribunal found that Dr. Thomas engaged in disgraceful, dishonourable or unprofessional conduct by not disclosing, on his 2012 Annual Renewal form, that he had been charged with a criminal offence in the previous year, specifically dangerous operation of a motor vehicle. Additionally, Dr. Thomas failed to report to the College when he was found guilty of this charge in 2014. Read more.


Dr. Mei Lump-Mee Hwang #61395 

On March 8, 2024, the Tribunal found that Dr. Hwang: 

  • Contravened terms, conditions and limitations on her certificate of registration by breaching her undertaking to the College; 
  • Failed to respond appropriately or within a reasonable time to written inquiries from the College; and 
  • Engaged in disgraceful, dishonourable or unprofessional conduct by:
    • failing to cooperate with the College’s investigation; and
    • in relation to Patient A, failing to respond to requests for medical information and failing to attend scheduled appointments

Dr. Waldemar Jacek Kozerawski #51496 

On February 28, 2024, the Tribunal found that Dr. Kozerawski engaged in disgraceful, dishonourable or unprofessional conduct by: 

  • providing care and treatment on an ongoing basis to Patient A who is also family member; and 
  • improperly using, improperly storing and failing to properly dispose of prescription medications of patients. 

The panel further found that Dr. Kozerawski failed to maintain the standard of practice of the profession in his care and treatment of Patient A. Read More.  


Dr. Moyez Bahadurali Amarshi Mawji Ladhani #61101 

On April 4, 2024, the Tribunal found that Dr. Ladhani engaged in disgraceful, dishonourable or unprofessional conduct in relation to his behaviour at Hamilton Health Sciences, including:  

  • taking a colleague’s bag without their knowledge or consent;  
  • inappropriately disposing of and/or attempting to dispose of some of the contents of the colleague’s bag, including the colleague’s personal documents and patient medical records; and  
  • providing false and/or misleading information during the hospital’s security investigation.

Dr. Heung-Wing Li #32486 

On March 4, 2024, the Tribunal found that Dr. Li: 

  • Failed to maintain the standard of practice of the profession in relation to completing Accessible Parking Permit applications; 
  • Engaged in disgraceful, dishonourable or unprofessional conduct and contravened a term, condition or limitation on his certificate of registration by engaging in clinical encounters with female patients, including in relation to completing Accessible Parking Permit applications for female patients; and 
  • Engaged in disgraceful, dishonourable or unprofessional conduct by improperly accepting money in exchange for completing Accessible Parking Permit applications.
