The Ontario Physicians and Surgeons Discipline Tribunal (OPSDT) is a neutral, independent, administrative tribunal that adjudicates allegations of professional misconduct or incompetence made by CPSO.

Below are summaries of decisions of OPSDT over the past 12 months. The OPSDT entry for each outcome is linked at the bottom of each summary.

OPSDT Report - September 2025 Board Meeting

Dr. Ajeet Singh Sidhu – CPSO #123011

On May 6, 2025, the Tribunal found that Dr. Sidhu engaged in professional misconduct by settling an allegation with a health profession regulator outside of Ontario, which constitutes professional misconduct or incompetence under Ontario legislation.

The Tribunal’s finding was based on records from the Medical Board of California, which had filed an Accusation alleging that Dr. Sidhu engaged in sexual misconduct with a patient while practising in that jurisdiction. To resolve the pending discipline proceedings, Dr. Sidhu voluntarily entered into a Stipulated Surrender of License and Order, surrendering his certificate to practice in California.

Penalties: 

  1. Reprimand
  2. Suspension for ten (10) months commencing May 7, 2025 at 12:01 a.m.;
  3. Terms, conditions and limitations on Dr. Sidhu’s certificate of registration; and
  4. Pay the College costs of $6,000 by June 4, 2025.

Dr. Sonja Sophia Kustka – CPSO #53928

In its reasons for decision released March 5, 2025, the Tribunal found that Dr. Kustka, in her failure to cooperate with the College’s investigation and by breaching the terms of an interim order made under section 25.4 of the Health Professions Procedural Code:

  • Engaged in disgraceful, dishonourable or unprofessional conduct;
  • Failed to respond appropriately or within a reasonable time to a written inquiry from the College; and
  • Contravened a term, condition or limitation on her certificate of registration.

The panel’s reasons for decision on penalty were released on June 17, 2025.

Penalties:

  • Reprimand
  • Suspension commencing at 12:01 a.m. on June 18, 2025, and continuing until the later of:
    1. Four months from the date of this order;
    2. The date that Dr. Kustka provides the following information and documents, without redaction and to the College’s satisfaction:
      • Physician Practice Questionnaire and Electronic Records Questionnaire;
      • A list of all patients to whom she has:
        • Provided COVID-19 related medical exemptions (Vaccine, Masks, Testing)
        • Prescribed Ivermectin
      • A complete copy of each identified patient’s medical record;
      • Consent to make appropriate inquiries to OHIP to monitor her compliance with the Interim Order
      • A log of all professional encounters with patients (“the Patient Log”).
  • Revocation of Dr. Kustka’s certificate of registration on a date set by the Registrar if:
    1. Six months have passed since the initial four-month suspension period or since any appeal rights have been exhausted, whichever comes later; and
    2. Dr. Kustka remains suspended under this order.
  • Pay the College costs of $39,295 by July 17, 2025.

Dr. George John Polemidiotis - CPSO #67955

On June 3, 2025, the Tribunal found that Dr. Polemidiotis engaged in professional misconduct by:

  • Engaging in sexual abuse of Patients A and B, which also constituted disgraceful, dishonourable, or unprofessional conduct;
  • Being found guilty of an offence relevant to his suitability to practise, having been convicted of three counts of sexual assault under s. 271 of the Criminal Code of Canada, involving three patients, including Patient A. 

The Tribunal also found that Dr. Polemidiotis engaged in disgraceful, dishonourable, or unprofessional conduct and conduct unbecoming of a physician based on the conduct underlying the criminal charges and convictions.

Penalties: 

  1. Reprimand;
  2. Revocation effective June 4, 2025 at 12:01 a.m.; and
  3. Pay the College costs of $6,000 by July 3, 2025.

Dr. Mehdi Horri – CPSO #87715

On June 2, 2025, the Tribunal found that Dr. Horri committed professional misconduct based on a prior finding by the College of Physicians and Surgeons of Saskatchewan (CPSS), which related to a breach of an undertaking. Dr. Horri breached the CPSS undertaking by having a professional encounter with a four-year-old female patient, contrary to the condition requiring that a female monitor be present for all female patient encounters.

The Tribunal found that the misconduct established by the CPSS would also constitute professional misconduct under section 51 of the Code. In addition, the Tribunal found that by breaching the CPSS undertaking, Dr. Horri engaged in disgraceful, dishonourable, or unprofessional conduct.

The Tribunal further found that Dr. Horri failed to report two criminal charges made by the Saskatchewan Police: one in September 2023 for dangerous driving, and another in March 2024 for sexual assault. Both charges were later stayed. Dr. Horri’s failure to report these charges constituted disgraceful, dishonourable, or unprofessional conduct. 

Penalties: 

  1. Reprimand;
  2. Suspension for twelve (12) months commencing June 3, 2025, at 12:01 a.m.; and
  3. Pay the College costs of $6,000 by July 1, 2025.

Dr. Cholemkeril Kuncheria Thomas - CPSO#54092

On July 15, 2025, the Tribunal found that Dr. Thomas committed professional misconduct in that he:

  • engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable, or unprofessional; and
  • was found guilty of an offence relevant to his suitability to practice. 

These findings arose from Dr. Thomas’s breach of an Undertaking with the Ontario Provincial Police, which prohibited him from communicating with the complainant in a sexual assault charge. Dr. Thomas pleaded guilty to failing to comply with a condition of the Undertaking, contrary to section 145(4)(a) of the Criminal Code of Canada, by communicating with the complainant. Dr. Thomas received a Conditional Discharge and was placed on one year of probation. Upon successful completion of the probationary period, the discharge became absolute on May 12, 2023.

 

Penalties: 

  1. Reprimand;
  2. Suspension for six (6) months, to commence August 26, 2025 at 12:01 a.m.; and
  3. Pay the College costs of $6,000 no later than one year from the date of this order.

OPSDT Report - May 2025 Board Meeting

Dr. Armen Parajian – CPSO #92997

Speciality: Thoracic Surgery, General Surgery

On March 27, 2025, the Tribunal found that Dr. Parajian, committed professional misconduct, having been found guilty of an offence relevant to his suitability to practise. On December 22, 2021, following a guilty plea in the Ontario Court of Justice, Dr. Parajian was convicted of criminal harassment. The conviction involved thirteen female victims (twelve minors between the ages of 10 and 15 and one adult), contrary to ss. 264(1) of the Criminal Code of Canada
 
Further, on or about May 17, 2021, while Dr. Parajian was inside his parked vehicle on a residential street during the day, he masturbated himself while members of the public were in proximity to his vehicle, including an adult and two minors.

The Tribunal found that the above-described acts would reasonably be regarded by members as disgraceful, dishonourable or unprofessional. 

Penalties: 

  • Reprimand;
  • Revocation effective March 28, 2025 at 12:01 a.m.; and
  • Dr. Parajian pay the College costs in the amount of $6,000 by April 28, 2025.

Dr. Marko Duic – CPSO #50470

On February 6, 2025, the Tribunal found that Dr. Duic, in his care and treatment of Patient A, failed to maintain the standard of practice of the profession, demonstrated a lack of knowledge, skill and judgment, and exposed Patient A to risk of harm and injury.

  • Suspension for three (3) months commencing February 7, 2025 at 12:01 a.m.;
  • Terms, conditions and limitations on Dr. Duic’s certificate of registration;
  • Dr. Duic pay the College costs in the amount of $6,000 by March 7, 2025.

Dr. Dorota Maria Kadlubowska – CPSO #113435

On February 25, 2025, the Tribunal found that Dr. Kadlubowska engaged in disgraceful, dishonourable or unprofessional conduct in that she:

  • provided medical care and treatment to Patient A who was a person close to her; and
  • disclosed the personal health information of six patients to Patient A without the affected patients’ knowledge or consent.

Penalties: 

  • Reprimand;
  • Suspension for 14 months, commencing February 26, 2025 at 12:01 a.m.;
  • Terms, conditions and limitations on Dr. Kadlubowska’s certificate of registration;
  • Dr. Kadlubowska pay the College costs in the amount of $6,000, payable within 6 months.

Dr. Robert Stanley Richards – CPSO #52929

Dr. Sean Carlysle Prabhu – CPSO #110504

On January 31, 2025, the Tribunal found that Dr. Prabhu: 

  • engaged in sexual abuse of a patient by engaging in a physical sexual encounter with Patient A; paying Patient A money in relation to the encounter; and sending inappropriate sexual communications to Patient A.
  • engaged in disgraceful, dishonorable or unprofessional conduct during the College’s investigation, including asking Patient A to withdraw her complaint to the College; having Patient A send an email to the College investigator purporting to withdraw the complaint; and deleting electronic communications from his devices.

Penalties: 

  • Reprimand;
  • Revocation effective February 1, 2025 at 12:01 a.m.;
  • Dr. Prabhu pay the College costs in the amount of $6,000 by February 28, 2025;
  • Dr. Prabhu to reimburse the College $17,940 for funding provided for therapy and counselling under s. 85.7 of the Health Professions Procedural Code and to post security acceptable to the College to guarantee the payment of this amount, by February 28, 2025.

Dr. Youssef Adel Slataroff – CPSO #87329

On January 14, 2025, the Tribunal found that Dr. Slataroff engaged in disgraceful, dishonourable or unprofessional conduct in that he:

  • made inappropriate remarks towards Patients, A, B and C;
  • touched Patient B’s body in an inappropriate manner, including hugging Patient B and moving her scarf to expose a scar on her neck; and
  • touched Patient C’s body in an inappropriate manner by putting his hand on her shoulder.

Dr. Vijay Sharma – CPSO #62959

On January 24, 2025, the Tribunal found that Dr. Sharma failed to maintain the standard of practice of the profession in his care of Patients A and B. 
 
The Tribunal further found that Dr. Sharma engaged in disgraceful, dishonourable or unprofessional conduct in that he:

  • inappropriately billed the Ontario Health Insurance Plan (OHIP) for services that were inconsistent with those provided; and
  • billed OHIP for services that were not clinically indicated.

  • Suspension for ten (10) months commencing January 25, 2025 at 12:01 a.m.;
