
Below are summaries of recent decisions of the Ontario Physicians and Surgeons Discipline Tribunal (OPSDT).

Dr. Jonathan Robert Keys — CPSO# 108159
Specialty: Family Medicine
On December 10, 2025, the Tribunal found that Dr. Keys engaged in disgraceful, dishonourable or unprofessional conduct by:
- providing treatment to Patient A, an individual with whom he had a close personal relationship, contrary to the College’s Treatment of Self, Family Members and Others Close to You policy; and
- disclosing without authorization the personal health information of other patients to Patient A, contrary to the College’s Protecting Personal Health Information policy.
Penalties:
- Dr. Keys attend before the panel to be reprimanded;
- the Registrar suspend Dr. Keys’ certificate of registration for ten (10) months commencing December 11, 2025;
- the Registrar place terms, conditions or limitations on Dr. Keys’ certificate of registration; and
- Dr. Keys pay the College costs in the amount of $6,000 by January 10, 2026

Dr. Dustin James Whitby Costescu — CPSO# 86495
Obstetrics and Gynecology
On January 7, 2026 the Tribunal found that Dr. Costescu, in his online personal communications with Patient A, committed the following act(s) of professional misconduct:
- under paragraph 1(1)33 of Ontario Regulation 856/93 made under the Medicine Act, 1991 (“O. Reg. 856/93”), in that the member has engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional.
Penalties:
- Dr. Costescu attend before the panel to be reprimanded;
- the Registrar suspend Dr. Costescu ’s certificate of registration for four months January 8, 2026 at 12:01 a.m.;
- the Registrar place terms, conditions and limitations on Dr. Costescu’s certificate of registration; and
- Dr. Costescu pay the College costs in the amount of $6,000 by Click or tap to enter a date.

Dr. Celeste Jean Thirlwell — CPSO# 76629
Specialty: Psychiatry
On December 12, 2025, the Tribunal found that Dr. Thirlwell, in her provision of medical exemptions from COVID-19 vaccination, masking and testing requirements and failure to cooperate with the College’s investigation, committed the following acts of professional misconduct:
- under paragraph 1(1)2 of Ontario Regulation 856/93 made under the Medicine Act, 1991 (“O. Reg. 856/93”), the member has failed to maintain the standard of practice of the profession;
- under paragraph 1(1)30 of O. Reg. 856/93, the member failed to respond appropriately or within a reasonable time to a written inquiry from the College; and
- under paragraph 1(1)33 of O. Reg. 856/93 the member has engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be
- regarded by members as disgraceful, dishonourable or unprofessional.
The Tribunal also found the registrant incompetent as defined by subsection 52(1) of the Health Professions Procedural Code.
Following the hearing on liability and penalty held on December 12, 2025, the Tribunal reserved its decision on penalty. The Tribunal’s reasons for decision and order on penalty were released on February 11, 2026.
Penalties:
- the Registrar revoke the registrant’s certificate of registration effective February 12, 2026 at 12:01 a.m;
- the registrant be reprimanded in writing, the fact and text of the reprimand appearing on the College’s public register; and
- the registrant pay costs to the College in the amount of $10,370 by March 13, 2026.

Dr. Faez Faruqi — CPSO# 85806
Specialty: Obstetrics and Gynecology
Previously, Dr. Faruqi, who also maintained a medical practice in Quebec, was found by the Collège des médecins du Québec (CMQ) to have committed professional misconduct while practising at a Quebec fertility clinic.
On December 1, 2025, the Tribunal found that the Quebec misconduct would constitute professional misconduct in Ontario and that the underlying conduct was disgraceful, dishonourable or unprofessional.
Penalties:
- Dr. Faruqi attend before the panel to be reprimanded;
- the Registrar suspend Dr. Faruqi’s certificate of registration for two months commencing December 2, 2025 at 12:01 a.m.;
- the Registrar place terms, conditions or limitations on Dr. Faruqi’s certificate of registration; and
- Dr. Faruqi pay the College costs in the amount of $6,000 by January 1, 2026.

Dr. Suman Khulbe — CPSO# 75449
Specialty: Family Medicine
In its reasons for decision released August 22, 2025, the Tribunal found that Dr. Khulbe sexually abused Patient A. The Tribunal further found that Dr. Khulbe engaged in disgraceful, dishonourable or unprofessional conduct, including:
- in her conduct and communications with Patients B, C and D;
- by inappropriately administering a substance (procaine) to herself and to Patients A, B and D; and
- by failing to maintain appropriate boundaries with patients, including hosting social gatherings at her medical clinic where alcohol was consumed and procaine was administered.
In accordance with section 51(4.2) of the Code, the Tribunal suspended Dr. Khulbe on an interim basis, given the nature of the sexual acts she was found to have engaged in with Patient A. The suspension took effect at 12:01 a.m. on August 23, 2025, pending the outcome of the penalty hearing.
A penalty hearing was held on November 24, 2025, after which the Tribunal reserved its decision on penalty. The panel’s reasons for decision on penalty were released on January 15, 2026.
Penalties:
- the Registrar revoke the registrant’s certificate of registration effective January 16, 2026 at 12:01 a.m.;
- the registrant appear before the panel to be reprimanded; and
- the registrant pay costs to the College in the amount of $124,440 by February 16, 2026.

Dr. Foluso Ayomitunde Olusegun Ola — CPSO# 81417
Specialty: Family Medicine
In its reasons released on August 21, 2025, the Tribunal found that Dr. Ola engaged in disgraceful, dishonourable, or unprofessional conduct by violating boundaries with Patients A, B, and C; and by deliberately billing OHIP for services that were not rendered, not clinically indicated, and did not meet the Schedule of Benefits criteria.
In addition, the Tribunal found that Dr. Ola failed to maintain the standard of practice of the profession in his care of Patients A, B and C.
A penalty hearing was held on November 12, 2025, after which the Tribunal reserved its decision on penalty. The panel’s reasons for decision on penalty were released on December 18, 2025.
Penalties:
- the registrant appear before the panel to be reprimanded;
- the Registrar revoke the registrant’s certificate of registration effective December 19, 2025 at 12:01 a.m;
- the registrant pay a fine of $35,000 to the Minister of Finance by January 19, 2026; and
- the registrant pay the College costs in the amount of $51,850 by January 19, 2026.

Dr. Luis Cesar Garcia Pan — CPSO# 55290
Specialty: No Specialty Reported
In its reasons for decision released September 17, 2025, the Tribunal found that Dr. Garcia Pan sexually abused AE, a patient. The Tribunal found that Dr. Garcia Pan:
- made inappropriate and/or sexual remarks to AE;
- engaged in inappropriate and/or sexual touching of AE, including of her breasts; and buttocks; and
- engaged in inappropriate and/or sexual behaviour towards AE.
The panel further found that these acts constituted disgraceful, dishonourable or unprofessional conduct.
In accordance with section 51(4.2) of the Code, the Tribunal suspended Dr. Garcia Pan on an interim basis, given the nature of the sexual acts he was found to have engaged in with AE. The suspension took effect at 12:01 a.m. on September 18, 2025, and remains in place pending the outcome of the penalty hearing.
A penalty hearing was held on November 11, 2025, after which the Tribunal reserved its decision on penalty. The panel’s reasons for decision on penalty were released on December 15, 2025.
Penalties:
- the Registrar revoke the registrant’s certificate of registration effective December 16, 2025 at12:01 a.m;
- the registrant appear before the panel to be reprimanded;
- the registrant pay the College costs of $103,700 by January 15, 2026; and
- the registrant reimburse the College $17,940 for funding provided for therapy and counselling under s. 85.7 of the Health Professions Procedural Code and to post security acceptable to the College to guarantee the payment of this amount, by January 15, 2026.

Dr. Jannice Margaret Istead — CPSO# 33443

On December 1, 2025, the Tribunal found that Dr. Istead engaged in disgraceful, dishonourable or unprofessional conduct and failed to respond appropriately or within a reasonable time to a written inquiry from the College by:
- failing to cooperate with a College assessment, including by failing to respond to College inquiries about the assessment in a timely manner or at all; and
- failing to cooperate with the College’s investigation into her failure to cooperate with the College assessment.
Penalties:
- Dr. Istead attend before the panel to be reprimanded;
- the Registrar suspend Dr. Istead’s certificate of registration for (2) months commencing December 2, 2025;
- the Registrar place terms, conditions and limitations on Dr. Istead’s certificate of registration; and
- Dr. Istead pay the College costs in the amount of $6,000 by December 31, 2025

Dr. Robert Joseph Stern — CPSO# 60770
Specialty: No Specialty Reported
On October 14, 2025, the Tribunal found that Dr. Stern committed professional misconduct:
- under clause 51(1)(a) of the Health Professions Procedural Code which is Schedule 2 to the Regulated Health Professions Act, 1991, S.O. 1991, c.18 (the “Code”), in he has been found guilty of an offence that is relevant to his suitability to practise;
- under paragraph 1(1)33 of Ontario Regulation 856/93 made under the Medicine Act, 1991 (“O. Reg. 856/93”), in that he has engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional; and
- under paragraph 1(1)34 of O. Reg. 856/93 in that he engaged in conduct unbecoming a physician.
These findings arise, in part, from Dr. Stern’s criminal convictions for possessing numerous photos and videos of child pornography involving children ranging in age from infants to twelve years old, and for committing voyeurism by concealing video cameras in his home.
Penalties:
- Dr. Stern attend before the panel to be reprimanded;
- the Registrar revoke Dr. Stern’s certificate of registration effective October 15, 2025 at 12:01 a.m.;
- Dr. Stern pay the College costs in the amount of $6,000 by November 14, 2025.

Dr. Ali Mohammed Namazie — CPSO# 82456
Specialty: Anesthesiology
On November 4, 2025, the Tribunal found that Dr. Namazie engaged in disgraceful, dishonourable or unprofessional conduct in that he failed to disclose to the College that he had been charged with criminal offences in 2022 and a further offence in 2024.
Penalties:
- Dr. Namazie attend before the panel to be reprimanded;
- the Registrar suspend Dr. Namazie’s certificate of registration for four months commencing November 5, 2025 at 12:01 a.m.;
- the Registrar place terms, conditions and limitations on Dr. Namazie’s certificate of registration;
- Dr. Namazie pay the College costs in the amount of $6,000 by November 4, 2025.
